Homeowner Release, Waiver of Liability and Covenant Not to Sue

I, the undersigned homeowner (“Homeowner”), representing myself and my real estate properties, hereby acknowledge and agree to the following terms and conditions of this Waiver of Liability and Covenant not to Sue (“Waiver”):

  1. Nature of Services: The Homeowner understands that it is soliciting construction work and services from an independent contractor, with iContractor only providing introductions between the Homeowner and the contractor. The scope of services to be provided by the Contractor will be specified in a separate agreement or contract between the homeowner and the Contractor.
  2. Assumption of Risk: The Homeowner acknowledges that the services being provided to the Homeowner involve certain risks and hazards. The Homeowner assumes, and agrees not to sue iContractor, all risks associated with the performance of a contractor, including but not limited to accidents, injuries, property damage, and any other risks inherent in the nature of the work to be performed for the homeowner, where such risks are not covered by insurance policies held by the Contractor. The Contractor shall be responsible for all materials delivered and work performed for the homeowner until completion and final acceptance.
  3. Personnel Liability of Contractor: The contractor is solely responsible for all physical injuries including death to its employees or to other persons or damages to any property sustained during its operation and work for a Homeowner. The contractor is solely responsible for the safety and protection of all its employees.
  4. Release and Indemnification: In consideration of the introduction to the contractor provided by iContractor, the Homeowner hereby releases, discharges, and holds harmless iContractor, its officers, directors, employees, agents, and affiliates from any and all claims, demands, actions, causes of action, liabilities, costs, expenses, or damages of any kind that may arise out of or in connection with provision of services by a contractor to the Homeowner.
  5. Compliance with Laws: The Homeowner agrees to comply with all applicable state and federal laws, regulations, and industry standards for the services provided by a contractor. The contractor, at its own cost, will obtain and maintain any required licenses, permits, or certifications necessary for the provision of its services to the Homeowner.
  6. Term: This Waiver shall be effective from the Date indicated below with the signature of the Homeowner until the end of the Homeowner’s use of the services of iContractor.
  7. Modification of Waiver: Any amendment or modification of this Waiver or additional obligation assumed by either the Homeowner or iContractor in connection with this Waiver will only be binding if evidenced in writing signed by the Homeowner and iContractor.
  8. Insurance: The Homeowner shall, at its sole cost and expense, procure and maintain, for the duration of this Contract, insurance coverage for insurance coverage not procured and maintained by a contractor against claims for injuries to persons or damages to property which may arise from or in connection with the performance of the work hereunder by the contractor, contractor's agents, representatives, officers, employees, or subcontractors (of all tiers). The following insurance coverage(s), as applicable, are required: commercial general liability insurance, workers' compensation insurance, professional liability / errors & omissions liability insurance.
  9. Promises: The Homeowner recognizes and acknowledges that iContractor makes no guarantees, warranties, representations, or other promises relative the services offered by contractors.
  10. Successors: This Contract shall be binding upon the undersigned, and his or her or their respective heirs, executors, administrators, personal representatives, successors, and assigns.

This Waiver will be governed by and construed in accordance with the laws of the State of Delaware.
